Terms & Conditions
These terms are the agreement between you and LoansForChristmas for using this site and its free lender-matching service. They cover who can use it, what we share with lenders, how lenders and partners may contact you, and where our role ends and the lender's begins. Sending a request means you accept them, so please read them first.
These Terms and Conditions (the "Terms") are an agreement between you and LoansForChristmas ("we", "us" or "our"). They apply to your use of loansforchristmas.com (the "Website") and the free lender-matching service on it. By using the Website or sending a request, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Website.
Who Can Use the Service
To use this service you must be a U.S. resident and at least 18 years old, and you must meet the requirements of the lenders in our network. The content on this Website is general information, not financial, legal or tax advice, and any figures shown are examples, not offers.
By using the Website, you confirm that you meet these requirements. Lenders choose which states they serve, so the lenders available to you depend on where you live, and in some states there may be none.
What the Service Is
LoansForChristmas (the "Website") is not an offer or solicitation to lend. The Website is not a lender, a broker, or an agent or representative of any lender, and it does not make loans or credit decisions. The Website collects the information you provide and forwards it to lenders and partners in our network. We don't charge you for using this service, and you're under no obligation to use it or to accept any offer. Loan amounts range from $500 to $35,000, and not all lenders offer the maximum. Submitting a request is not a promise of approval, or of a specific rate, term or amount. Transfer times vary by lender and by your bank.
When you send a request, we pass your details to lenders and lending partners in our network. A lender that wants to review your request may contact you or show you an offer. If you choose to go ahead, you apply with that lender and sign its loan agreement, and from then on the loan is between you and the lender. Our Lending Policy explains how lenders in our network review requests.
What the Service Is Not
We are not a lender, a bank or a broker, and we don't act for any lender. Lenders make every credit decision, including whether to approve you, how much to offer, and the rate, fees and repayment term. We don't fund loans, collect payments or service loan accounts.
The content on this site is for general educational purposes only and is not financial, legal or tax advice. Any figures shown are illustrations, not offers. If you'd like advice about your own situation, a qualified professional or a nonprofit credit counselor can help.
Accurate Information
You agree to give true, current and complete information in every form you send through the Website, using only your own name, contact details and financial information. Lenders rely on what you enter when they review your request. False or misleading details can lead a lender to decline your request, and giving false information to obtain credit may be against the law.
If something you entered changes or turns out to be wrong, tell the lender you're working with. If you haven't been matched yet, write to us and we'll help you correct it.
Your Obligations When Using the Website
When you use the Website, you agree to:
- use it only for your own personal and lawful purposes;
- not send a request for another person, or use someone else's identity or contact details;
- read a lender's full terms, including the APR, fees, total cost and repayment schedule, before you accept a loan;
- not copy, scrape or collect content or data from the Website by automated means;
- not try to gain unauthorized access to the Website, interfere with how it runs, or test it for security weaknesses without our written permission;
- not send anything unlawful, fraudulent, abusive or harmful through the Website, including malicious code.
If we reasonably believe these Terms have been broken, we may block access to the Website or decline to pass a request on to lenders.
Sharing Your Request With Lenders
By submitting a request, you agree that (a) your information may be shared with lenders and partners on your behalf, and (b) those lenders may obtain consumer reports about you from agencies such as TransUnion, Experian and Equifax to evaluate your creditworthiness.
Sending your request is how you ask us to share it. The details you enter go to one or more lenders and lending partners in our network so they can decide whether to make you an offer. Our Credit Authorization page explains lender credit checks in more detail. What we collect, who receives it and how to opt out of the sale or sharing of your personal information are covered in our Privacy Policy and on Your Privacy Choices.
Calls, Texts and Emails
By submitting your request, you agree to be contacted by LoansForChristmas and the lenders and lending partners in our network by phone, text message and email, including through automated or prerecorded technology, at the number and address you provide, even if it is on a do-not-call list. Consent is not a condition of any purchase. You can opt out at any time by following the instructions in any message you receive or by telling us through our Contact page.
Message frequency varies, and standard message and data rates may apply. To stop texts, reply STOP to any message. To stop emails, use the unsubscribe link in the email or tell us through our Contact page. Lenders you've already been matched with are separate companies, so you may also need to opt out with them by following the instructions in their messages.
Electronic Communications and Signatures
By using this website and submitting a request, you consent under the federal E-SIGN Act to receive all communications, agreements, disclosures, notices and other information from LoansForChristmas and the lenders and lending partners we connect you with in electronic form, including by email, by text message and by posting on this website, instead of on paper. To access and keep electronic communications you need a device with internet access, a current web browser and a valid email address, and you are responsible for keeping your contact details current. Standard message and data rates may apply to text messages, and you can stop texts at any time by replying STOP. You may withdraw this consent or ask for a free paper copy of any disclosure at any time through our Contact page, though doing so may mean we can no longer provide the matching service.
When you agree to something on the Website by checking a box or clicking a button, that agreement has the same legal effect as signing it on paper.
No Promise of Approval or Terms
Submitting a request is not a promise of approval, or of a specific rate, term or amount. Approval, APR, fees and funding are decided only by the lender.
A lender may offer you more or less than the amount you asked for, or no offer at all. The amount you see on our site is your request, not an offer.
Sending a request doesn't oblige you or any lender to do anything. You don't have to accept an offer, and you can stop at any point before you sign a loan agreement. Rates, fees and our representative cost examples are on the Loan Rates & Fees page, and what affects our stated approval rate is explained in our Disclosures.
How We Are Paid
LoansForChristmas may receive compensation from lenders or lending partners when a request is matched or funded. This compensation may affect which lenders appear in our network and how requests are routed. It does not change what you pay a lender.
Those payments are why the service is free to you, and they don't oblige you to accept any offer. If you reached us through an ad or a partner website, that partner may also be paid when you send a request.
Third-Party Lenders and Their Terms
Lenders and lending partners in our network are independent companies. We don't control them, and we aren't responsible for their decisions, offers, fees, messages, privacy practices or conduct. Each lender has its own application, loan agreement, privacy policy and terms of use, and those documents govern anything you agree with that lender. Read them before you accept a loan, and keep a copy.
A lender's loan agreement may include its own dispute-resolution or arbitration clause. That clause, not these Terms, applies to disputes about the loan. Questions about a loan you've accepted, a payment or a balance should go to the lender, using the contact details in your loan documents.
Some lenders in our network are tribal lending entities. The Tribal Lender Notice in our footer and on the Disclosures page explains how their rates, and the laws that govern them, may differ from those of state-licensed lenders.
The Website may link to other websites. We provide those links for convenience and don't control or endorse what those sites publish.
Intellectual Property
The Website and its content, including text, graphics, logos, images, video and design, belong to LoansForChristmas or its licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, change, republish, sell or distribute any part of the Website for commercial purposes without our written permission. The LoansForChristmas name and logo are our trademarks, and nothing in these Terms gives you a right to use them.
Disclaimer of Warranties
The Website and the matching service are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We don't promise that the Website will be uninterrupted, secure or free of errors, that a lender will make you an offer, or that an offer will suit your needs. Figures, examples and general information on the Website are illustrations and may not match the terms a lender offers you.
Limitation of Liability
To the fullest extent the law allows, LoansForChristmas and its owners, employees and service providers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or savings, arising from your use of the Website, your reliance on its content, or a loan or offer from a lender. We aren't a party to your loan, so we aren't responsible for a lender's decisions, terms, fees or conduct.
Where the law doesn't allow us to exclude a type of liability, our liability is limited to the smallest amount the law permits. Some states don't allow certain limits on liability, so parts of this section may not apply to you.
Indemnity
You agree to indemnify and hold harmless LoansForChristmas and its owners, employees and service providers from claims, losses, damages and costs, including reasonable legal fees, that result from your breach of these Terms, false information you submit, or your misuse of the Website. This doesn't apply to the extent a claim results from our own wrongdoing.
Disputes and Governing Law
If you have a problem with the Website or the service, please write to us first at [email protected]. We'll work with you in good faith to resolve it before either of us takes formal action.
These Terms are governed by applicable federal law and the laws of the state in which LoansForChristmas is based, without regard to conflict-of-law rules. If a dispute can't be settled informally, either of us may bring it in a court that has jurisdiction, including a small claims court for claims within its limits. We can also agree in writing to settle a particular dispute through arbitration. Nothing in these Terms takes away rights you have under the consumer protection laws of the state where you live.
Changes to the Service or These Terms
We may change, suspend or stop any part of the Website or the service at any time, and we may update these Terms. Updated Terms take effect when we post them on this page and apply to requests sent after that. If you keep using the Website after a change, you accept the updated Terms.
Other Terms
If a court finds part of these Terms unenforceable, the rest stays in effect. If we don't enforce a provision right away, we can still enforce it later. These Terms, our Privacy Policy and our Disclosures make up the whole agreement between you and us about the Website. You may not transfer your rights under these Terms. We may transfer ours, for example if the business is sold.
Contact Us
Questions about these Terms can go to [email protected] or through our Contact page. You can also write to us at LoansForChristmas, 925 N La Brea Ave 4th floor, Los Angeles, CA 90038. We reply by email.
